Investors with holdings in UBS Puerto Rico Funds continue to sustain losses. In just the last couple of months, UBS Puerto Rico Funds have lost over 50 percent of their value. Within the previous quarter Puerto Rico Funds have lost $1.9 billion. Investors in other municipal bond funds should also be concerned about the current state of Puerto Rican municipal debt. Many mutual funds and institutional investors own debit issued by Puerto Rico. About 75 percent of all muni-bond mutual funds include Puerto Rico municipal debt and each holds at least five percent of Puerto Rico debt in their portfolios, on average. Investors in the United States hold about $3.7 trillion in the municipal bond market and about $70 billion of the municipal bond market's total is held in Puerto Rico municipal debt.

While FinTech is revolutionizing the banking industry and giving millions of people access to financial services for the first time, new banking models are emerging with FinTech start-ups and tech firms potentially disrupting the status quo. But business schools and universities are not preparing future bankers for these changes, says FinTech thought leader Henri Arslanian. How can designers, programmers and creative thinkers help? Henri Arslanian started his career as a financial markets and funds lawyer in Canada and Hong Kong, after which he spent many years with UBS Investment Bank in Hong Kong. In recent years, he has been teaching graduate courses on Entrepreneurship in Finance at Hong Kong University as an Adjunct Associate Professor, and currently leads the first FinTech course in Asia. His latest book on Entrepreneurship in Finance will be published in late 2016 by Palgrave Macmillan. A member of the Milken Institute’s Young Leaders Circle, Henri is a regular keynote speaker globally on the topic of FinTech and hedge funds and currently sits on a number of finance, academic, civil society and FinTech related boards and advisory boards. Henri is fluent in English, French, Armenian, Spanish and conversational in Mandarin Chinese and has been awarded many academic and industry awards over the years, including the Governor General of Canada Gold Medal for Academic Excellence. For UBS clients who invested in the UBS Willow Fund L.L.C. (“Willow Fund” or the “Fund”) the FINRA arbitration process can be used to recover those investment losses. The Willow Fund was a private hedge fund sold to hundreds of UBS clients nationally. More than $200 million was lost by UBS clients who purchased or held an investment in the Willow Fund after January 1, 2008. In October 2012, investors were notified that the Willow Fund would be liquidated resulting in massive losses for many UBS clients (in excess of 80%) who were simply seeking to hedge their various other market positions. According to our investigation, various false and misleading representations and material omissions may have been made by UBS brokers to clients concerning the Willow Fund that induced investors to purchase the Willow Fund and to not redeem their investments. The misrepresentations and material omissions were made in the Willow Fund”s Offering Memorandum and Supplements (the “OM”) and quarterly summaries, on which investors relied, and concerned disclosure of the magnitude and nature of the Willow Fund”s risks, its investments, its borrowing restrictions, its concentration limits, its valuation policies, and its risk management controls as related to its trading of credit default swaps (“CDS”). UBS is sticking with its recommendations that some clients buy risky Puerto Rico closed-end bond funds, despite hundreds of arbitration claims by investors who blame the securities for huge losses, according to an internal document. According to an Oct. 9 internal memo reviewed by Reuters, UBS told brokers that they may continue to recommend the funds to clients following a $5.2 million settlement last week with Puerto Rico's financial institutions regulator about sales practices involving the funds. A UBS spokeswoman did not say whether the firm planned to give more specific guidance to brokers. The investment banking industry has come under criticism for a variety of reasons, including perceived conflicts of interest, overly large pay packages, cartel-like or oligopolic behavior, taking both sides in transactions, and more. Conflicts of interest may arise between different parts of a bank, creating the potential for market manipulation, according to critics. Authorities that regulate investment banking (the FSA in the United Kingdom and the SEC in the United States) require that banks impose a "Chinese wall" to prevent communication between investment banking on one side and equity research and trading on the other. Critics say such a barrier does not always exist in practice, however. Conflicts of interest often arise in relation to investment banks' equity research units, which have long been part of the industry. A common practice is for equity analysts to initiate coverage of a company in order to develop relationships that lead to highly profitable investment banking business. In the 1990s, many equity researchers allegedly traded positive stock ratings for investment banking business. Alternatively, companies may threaten to divert investment banking business to competitors unless their stock was rated favorably. Laws were passed to criminalize such acts, and increased pressure from regulators and a series of lawsuits, settlements, and prosecutions curbed this business to a large extent following the 2001 stock market tumble after the dot-com bubble. Philip Augar, author of The Greed Merchants, said in an interview that, "You cannot simultaneously serve the interest of issuer clients and investing clients. And it's not just underwriting and sales; investment banks run proprietary trading operations that are also making a profit out of these securities."[30] Many investment banks also own retail brokerages. During the 1990s, some retail brokerages sold consumers securities which did not meet their stated risk profile. This behavior may have led to investment banking business or even sales of surplus shares during a public offering to keep public perception of the stock favorable. Since investment banks engage heavily in trading for their own account, there is always the temptation for them to engage in some form of front running -- the illegal practice whereby a broker executes orders for their own account before filling orders previously submitted by their customers, there benefiting from any changes in prices induced by those orders. Documents under seal in a decade-long lawsuit concerning eToys.com's IPO but obtained by New York Times' Wall Street Business columnist Joe Nocera alleged that IPOs managed by Goldman Sachs and other investment bankers involved asking for kickbacks from their institutional clients who made large profits flipping IPOs which Goldman had intentionally undervalued. Depositions in the lawsuit alleged that clients willingly complied with these demands because they understood it was necessary in order to participate in future hot issues.[32] Reuters Wall Street correspondent Felix Salmon retracted his earlier, more conciliatory, statements on the subject and said he believed that the depositions show that companies going public and their initial consumer stockholders are both defrauded by this practice, which may be widespread throughout the IPO finance industry.[33] The case is ongoing, and the allegations remain unproven. Investment banking is often criticized for the enormous pay packages awarded to those who work in the industry. According to Bloomberg Wall Street's five biggest firms paid over $3 billion to their executives from 2003 to 2008, "while they presided over the packaging and sale of loans that helped bring down the investment-banking system." [34] The highly generous pay packages include $172 million for Merrill Lynch & Co. CEO Stanley O'Neal from 2003 to 2007, before it was bought by Bank of America in 2008, and $161 million for Bear Stearns Co.'s James Cayne before the bank collapsed and was sold to JPMorgan Chase & Co. in June 2008.[34] Such pay arrangements have attracted the ire of Democrats and Republicans in Congress, who demanded limits on executive pay in 2008 when the U.S. government was bailing out the industry with a $700 billion financial rescue package.[34] Writing in the Global Association of Risk Professionals, Aaron Brown, a vice president at Morgan Stanley, says "By any standard of human fairness, of course, investment bankers make obscene amounts of money." http://en.wikipedia.org/wiki/Investment_bank

On August 9, 2018, federal prosecutors indicted former UBS broker and investment adviser, John Maccoll, on criminal charges and the Securities and Exchange Commission filed civil charges against him alleging he stole clients' funds to the tune of $4 million. Maccoll was employed by UBS Financial Services Inc. from January 2006 through March 2018. On March 15, 2018, UBS disclosed that it discharged Maccoll because he failed to cooperate with its investigation into whether he stole a client's funds. According to UBS, Maccoll later told UBS "that he misappropriated funds from 13 clients." Most claims allege Maccoll caused his customers' losses through fraud or unsuitable investment recommendations. A broker, like Maccoll, must recommend only investments that are suitable to a customer based on factors such as the customer's age, investment experience, risk tolerances, and financial status. A brokerage firm, like UBS, has a duty to reasonably supervise its brokers, including to ensure they do not recommend unsuitable investments or commit fraud. A firm has a duty to place a broker with a history of customer complaints on heightened supervision. When these duties are breached, customers have claims for their losses.
